Compliance Expert

Position:

All members of the Compliance department are responsible to take part in the execution of their part of the Compliance Action Plan within their area of expertise and together with the other team members, in order to ensure :

  • Policy Ensuring proper a “policy framework” in its areas of expertise and testing and controlling the policy framework in its areas of expertise for both ERGO Insurance nv and ERGO Partners nv, taking into account all current legal, regulatory and statutory requirements, as well as implementing appropriate second line controls, monitoring and substantive testing measures within the company and (partially) on the first line controls. Ensure confirmation, regular review and update of the global policy framework. Advice on and evaluate the implementation of company’s internal guidelines and procedures and identify gaps, for all Compliance domains. Conducting sample testing and monitoring to ensure their proper implementation.
  • Regulatory Watch (Tracking legislation and other regulations regarding compliance) Organize, follow up and keep track of the various national and international regulations and the way they are interpreted regarding the compliance domains. Part of this work is to examine relevant internal and external documents on policy and operations (e.g. for topics relating to the compliance function: internal and external audit reports, minutes of Management Board meetings, minutes of meeting of the Board of Directors, information and notes from the supervisory authorities).
  • Risk Assessments (Compliance Risk Management) Identifying, examining, update and properly evaluating the compliance risks in cooperation with relevant departments / process owners and the policy framework around the management of these risks.
  • Annual Compliance Action Plan and Reporting Several regular reporting on Compliance have to be provided to the business owners and to the MC or to the Audit Committee. Part of the annual tasks are to provide an annual compliance plan with a detailed description of the nature and frequency of the tasks that the department will carry out within the time period. In addition to the annual report of the compliance function, a specialized annual report on anti money laundering and on Privacy has to be prepared (and transmitted to the supervisory authorities). In case of detection of fraud, incompliance, litigations, money laundering is additional specific respective ad hoc reports have to be provided. Furthermore the assurance of proper reporting on FATCA & CRS towards authorities is also in the responsibility of Compliance.
  • Monitoring Ensuring effectiveness and documentation of the 2nd line monitoring framework is part of the function.
  • Regulatory contact Ensuring capture, follow up and proper answers to the Regulators' requests is an important part of the work of the Compliance department.
  • Training & Awareness (Training staff) Part of the job of the Compliance department is to facilitate compliance by ensuring that directors, management, staff members and tied agents receive appropriate compliance training and that there is an adequate level of awareness with respect to compliance risk within the organization, eventually via the LRCSCs. Ensuring notification and documentation update regarding procedures, guidelines and related obligation to be complied with.
  • Advisory role (Providing advice and communication requirements) Pragmatic and documented advise has to be provided to the “Business” upon request, where related issues or projects are detected, under design or implementation. Documented advise or warning notification has to be provided to all employees in case of effective unethical behavior regarding gifts and invitations, whistle blowing and additional activities / occupations. In case of breaches of conduct or fraud the respective senior management and / or Management Committee will have to be escalated.

Profile:

Master Level in Law or in Economic sciences, min 5 years experience within the Financial sector (ideally life insurance), or min 4 years of compliance, auditing, internal control or consultancy experience in the Financial sector.

In order to succeed in this role candidate will need to demonstrate interest and/or competencies in several of the following areas:

  • Life insurance knowledge
  • Good knowledge of Insurance distribution channels

  • Good knowledge of customers’ rights and information
  • Corporate governance knowledge
  • Compliance technical experience in Life Insurance environment : Compliance Risk assessment, substantive testing and monitoring
